CONTEST OFFICIAL RULES AND REGULATIONS
March 28, 2014 – October 24, 2014

 

HOW TO PARTICIPATE        

The following numbering is done with the Alt NG (general) numbering macro.  The numbered paragraphs use List styles.  The shortcut keys are Alt G1, Alt G2 etc. 

1.              ENTRY: Between 12:01 A.M. Pacific Time on March 28, 2014 and 8:59 A.M. Pacific Time on October 24 28, 2014 (the “Contest Period”), eligible individuals (See ELIGBILITY in Section 3 below) will have the opportunity to submit contest entries at: www.whitecapsfc.com/CapsAroundTheWorld (“Entrants”). Entrants will be required to submit full contact information (full name, phone number, and email). Each entry must include an appropriate image of the Entrant in Whitecaps FC branded merchandise (the “Image”). No purchase is necessary to enter the Contest.

2.              CONTEST SPONSORS: The contest sponsors are Vancouver Whitecaps FC L.P., by its general partner WFC Football GP Ltd., and Alaska Airlines (the “Contest Sponsors”).

3.              ELIGIBILITY: To be eligible to enter and to win the Contest, an Entrant must be a legal resident of the Province of British Columbia, Canada, and meet all other requirements in these Rules. Employees of the Contest Sponsors and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsors, its agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter.

PRIZES AND SELECTION OF WINNERS

4.              PRIZES: Each Contest prize (a “Prize”) is listed in the table below and will be awarded after the end of the applicable draw closing date from all entries received up to the applicable draw closing date within five (5) business days of each applicable draw closing date. Each Prize is valid for one year from date of issue on flights served by Alaska Airlines flights numbered (1-999, 2000 -2999) and/or Sky West Airlines flights (3450-3499). Mileage Plan Miles cannot be earned or credited. First Class paid upgrades or mileage plan upgrades are allowed. Stopovers and connections are also allowed (subject to fare rules) Standard baggage fees apply; see the checked baggage policy and flight schedules at www.alaskaair.com for more details. Individual travel taxes may apply.  Once ticketed, fare rules apply regarding changes to itinerary.

5.               SELECTION OF WINNERS: Prize One and Prize Two will be awarded to the Entrant selected by the Contest Sponsors, in their sole and absolute discretion, on the basis of a consideration of the quality of the Image submitted by each Entrant (a “Selected Entrant”). The Selected Entrant for the Grand Prize will be an Entrant selected by the Contest Sponsors, in their sole and absolute discretion, from amongst a pool of the five (5) Entrants who receive the highest number of votes through the online voting mechanism during the Contest period on the basis of a consideration of the quality of the Image submitted by each Entrant. An Entrant may only become a Selected Entrant once during the Contest Period.

6.              ACCEPTANCE OF PRIZES: The Selected Entrant will be contacted by telephone or email at the number or email address provided in their Contest entry submission. If a Selected Entrant: (a) cannot be reached by phone by the Contest Sponsors within three (3) business days following the applicable Prize draw; (b) declines the Prize; or (c) fails to comply with any other requirement in these Rules, the Contest Sponsors reserve the right to select another Entrant or to cancel the Prize. Prizes awarded pursuant to the Contest must be accepted as awarded. No Prize may be sold, transferred, substituted, redeemed or converted to cash. The Contest Sponsors reserve the right to substitute one or more of the Prizes, in whole or in part, in the event that any component of any such Prize is unavailable.

7.              GRAND PRIZE: Due to the nature of the Grand Prize, no alternative dates are available other than those selected by the Contest Sponsors. The Grand Prize winner and guest are solely responsible for ground transportation, spending money in addition to the amount included in the prize, tips, meals and other charges not specifically mentioned as part of the Grand Prize. The Grand Prize winner and guest are solely responsible for obtaining their own travel documents such as a valid passport or travel visa in advance of the departure date, and must not have any restrictions on ability to travel. The Contest Sponsors is not responsible in the event the Grand Prize winner or guest, or both, are refused entry to the destination country or re-entry into Canada for whatever reason and any unused portion of the Grand Prize will be forfeited.

8.              ODDS: The odds of being selected to win a Prize depend on the total number of eligible entries received during each applicable contest period.

 

GENERAL TERMS AND CONDITIONS

9.              ACCEPTANCE OF RULES: By entering this Contest the Entrant agrees to accept and abide by these Rules. All decisions of the Contest Sponsors with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all Entrants in all matters as they relate to this Contest. Anyone whose submission involves anything illegal, potentially or actually dangerous or harmful or containing any element of physical risk may be disqualified from the Contest. Any entry that involves a third party that does not choose to be part of the submission will be disqualified.

10.            IDENTITY: The Contest Sponsors shall reserve the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification.  

11.            RELEASE: By entering this Contest, Entrants release and hold harmless the Contest Sponsors, their advertising and promotional agencies, their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the "Releasees") from any liability in connection with this Contest or, if declared a winner, the Prizes. Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release. If a Prize allows a winning Entrant to select a guest to accompany the Entrant, that guest may also be required to sign and return a Liability and Publicity Release within such period as the Contest Sponsors may specify. By accepting a Prize, winners consent to the use of their name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.

12.            NO RESPONSIBILITY: The Contest Sponsors assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected entries, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with Entrants requesting these Rules by mail or requesting names of Prize Winners (for which a self-addressed, postage paid envelope must be included). The Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials-data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, the Contest Sponsors reserves the right to cancel, terminate, modify, amend, extend or suspend the Contest including cancelling any method of entry, and at their discretion may elect to select a potential winner from previously received eligible entries. The Contest Sponsors reserve the right to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsors reserve the right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent of the law. The Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an Entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site, where applicable.

13.            SUBJECT TO LEGISLATION: The Contest is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited. Personal information collected from Entrants will be used by the Contest Sponsors for the purpose of administering this Contest and, if consent is given at the time of entry, to provide the Entrants with marketing information relating to new and existing products and upcoming promotions of the Contest Sponsors. The Contest Sponsors will not sell, share or otherwise disclose personal information of Entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law. By entering the Contest, Entrants consent to the manner of collection, use and disclosure of personal information as set out in the Contest Sponsors’ Privacy Policy at www.whitecapsfc.com/CapsAroundtheWorld. 14.            CONTEST RULES GOVERN: In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and any disclosure or other statements contained in any Contest related materials, including but not limited to point of sale materials, television advertising, print advertising or online advertising, the terms and conditions of these Rules shall prevail, govern and control.

15.            INTELLECTUAL PROPERTY: All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsors and/or their affiliates or third-party licensors. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

16.            APPLICABLE LAW: This Contest shall be interpreted, construed and governed by the laws in force in the Province of British Columbia, Canada, without reference to its conflict of laws principles.
